TheCleanAirAct1993andSmokeControlAreas
UndertheCleanAirActlocalauthoritiesmaydeclarethewholeorpartofthedistrictofthe
authoritytobeasmokecontrolarea.Itisanoffencetoemitsmokefromachimneyofa
building,fromafurnaceorfromanyfixedboileriflocatedinadesignatedsmokecontrol
area.Itisalsoanoffencetoacquirean"unauthorisedfuel"forusewithinasmokecontrol
areaunlessitisusedinan"exempt"appliance("exempted"fromthecontrolswhich
generallyapplyinthesmokecontrolarea).
TheSecretaryofStateforEnvironment,FoodandRuralAffairshaspowersundertheActto
authorisesmokelessfuelsorexemptappliancesforuseinsmokecontrolareasinEngland.In
ScotlandandWalesthispowerrestswithMinistersinthedevolvedadministrationsforthose
countries.Separatelegislation,theCleanAir(NorthernIreland)Order1981,appliesin
NorthernIreland.Thereforeitisarequirementthatfuelsburntorobtainedforuseinsmoke
controlareashavebeen"authorised"inRegulationsandthatappliancesusedtoburnsolid
fuelinthoseareas(otherthan"authorised"fuels)havebeenexemptedbyanOrdermade
andsignedbytheSecretaryofStateorMinisterinthedevolvedadministrations.
TheMarvichasbeenrecommendedassuitableforuseinsmokecontrolareaswhenburning
wood.Thefittingofasy stemtothesecondaryaircontrolshouldbeimplementedwithin
smokecontrolareastoensurethattheairsupplyholesremain3mmopenwhenthe
operatorhasnominallyfullyshutthecontrol.
