7. LIMITATION OF LIABILITY.
UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL FLUKE NETWORKS
BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL
DAMAGES ARISING OUT OF OR RELATING TO THIS LICENSE. SOME JURISDICTIONS
DO NOT ALLOW THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES
SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Fluke Networks’ total
liability to you for all damages exceed the amounts paid by you hereunder.
8. GOVERNMENT END USERS.
AirMagnet Software is a “commercial item,” “commercial computer software” and/or
“commercial computer software documentation.” Consistent with DFAR section 227.7202,
FAR section 12.212 and other sections, any use, modification, reproduction, release,
performance, display, disclosure or distribution thereof by or for the U.S. Government shall be
governed solely by the terms of this License and shall be prohibited except to the extent
expressly permitted by the terms of this License.
9. CONTROLLING LAW AND SEVERABILITY.
This License shall be governed by the laws of the United States and the State of Washington,
U.S.A., without reference to its conflict of law principles. The United Nations Convention on
the International Sale of Goods shall not apply to this License. If for any reason a court of
competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the
remainder of this License shall continue in full force and effect.
10. COMPLETE AGREEMENT.
This License constitutes the entire agreement between the parties with respect to the use of the
AirMagnet Software and supersedes all prior or contemporaneous understandings regarding
such subject matter. No amendment to or modification of this License will be binding unless
in writing and signed by Fluke Networks.
