Warranty
1. Warranty Coverage
LP warrants to the original purchaser (“Purchaser”) of LP Redwood Panels
("Product") that as of the date of their manufacture, the Product meets the
specifications published in the then current version of ANSI 135.6. This warranty
is strictly limited to Products installed on structures permanently located in North
America (United States, Canada and Mexico.)
2. Claims Period.
The claims period for any breach of this express Limited Warranty is one (1) year
from the date the Product was originally purchased.
3. No Warranty Transfer
This Limited Warranty Is issued to the original Purchaser of the Product and may
not be transferred.
4. Exclusions from Warranty Coverage
This Limited Warranty does not cover or provide a remedy for damage that results
from:
A. MISUSE OR IMPROPER STORAGE, HANDLING, INSTALLATION, FINISHING
OR MAINTENANCE; ALTERATIONS TO THE PRODUCT AFTER THE ORIGINAL
INSTALLATION; ACTS OF GOD SUCH AS HURRICANE, TORNADO, HAIL,
EARTHQUAKE, FLOOD OR OTHER SIMILAR CAUSE BEYOND LP’S CONTROL;
DESIGN, APPLICATION OR CONSTRUCTION OF THE STRUCTURE ON WHICH
THE PRODUCT IS INSTALLED; TRANSPORT, STORAGE OR HANDLING OF THE
PRODUCT PRIOR TO INSTALLATION;
B. PRODUCT THAT IS NOT INSTALLED, FINISHED AND MAINTAINED IN STRICT
ACCORDANCE WITH LP’S INSTRUCTIONS IN EFFECT AT THE TIME THE
PRODUCT WAS ORIGINALLY PURCHASED;
C. SWELLING OR EDGE CHECKING. THESE OCCUR NORMALLY IN ALL WOOD
PRODUCTS AS THEY EXPAND AND CONTRACT IN RESPONSE TO CHANGES
IN WEATHER;
D. INSTALLATION WORKMANSHIP;
E. PRODUCT EXPANSION OR BUCKLING; OR
F. DECAY FUNGI OR TERMITES.
5. Exclusion of Implied Warranties; No Other Express Warranties
THIS LIMITED WARRANTY IS THE ONLY WARRANTY APPLICABLE TO THIS
PRODUCT AND EXCLUDES ALL OTHER EXPRESS OR IMPLIED WARRANTIES,
INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR
A PARTICULAR PURPOSE, OR ANY WARRANTIES OTHERWISE ARISING FROM
THE COURSE OF DEALING OR USAGE OF TRADE OR ADVERTISING, EXCEPT
WHERE SUCH WARRANTIES ARISE UNDER APPLICABLE CONSUMER PRODUCT
WARRANTY LAWS AND CANNOT LAWFULLY BE DISCLAIMED, IN WHICH EVENT
SUCH WARRANTIES ARE LIMITED TO SUCH SHORTER PERIOD AS PERMITTED
OR REQUIRED UNDER APPLICABLE LAW.
Some states and provinces do not allow limitations on how long an implied
warranty lasts, so the above limitations may not apply to you.
NO OTHER EXPRESS WARRANTY HAS BEEN MADE OR WILL BE MADE ON
BEHALF OF LP WITH RESPECT TO THIS PRODUCT.
6. Remedies
THIS SECTION PROVIDES THE SOLE REMEDY AVAILABLE TO THE PURCHASER
FROM LP FOR ANY FAILURE OF THE PRODUCT TO PERFORM AS WARRANTED.
If the Product(s) fails to perform as warranted under this Limited Warranty or
any implied warranty not disclaimed in Section 5, LP will, at its sole option and at
its expense, either provide new uninstalled Product; or refund the original value
of the Product found to be non-conforming. The original Limited Warranty shall
apply to any replaced or repaired Product(s). The claims period for such replaced
or repaired Product(s) will extend for the balance of the original warranty period
in effect at the time the original Product(s) proved to be nonconforming. IN
NO EVENT SHALL LP’S LIABILITY FOR NON-CONFORMANCE TO THIS LIMITED
WARRANTY EXCEED TWICE THE ORIGINAL PURCHASE PRICE OF THE NON-
CONFORMING PRODUCT.
7. Exclusion of Other Remedies
IN NO EVENT WILL LP BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT,
MULTIPLE, PUNITIVE OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY
PRODUCT NON-CONFORMITY, INCLUDING, BUT NOT LIMITED TO DAMAGE
TO PROPERTY OR LOST PROFITS REGARDLESS OF WHETHER SUCH CLAIMS
ARE BASED ON THEORIES OF CONTRACT, WARRANTY, TORT (INCLUDING
NEGLIGENCE AND GROSS NEGLIGENCE), STRICT LIABILITY, STATUTORY
LIABILITY OR OTHERWISE.
Some states and provinces do not allow the exclusion or limitation of
incidental or consequential damages, so the above limitation or exclusion
may not apply to you.
8. Purchaser Responsibilities.
COMPLIANCE WITH EACH OF THE ITEMS SET OUT BELOW IS A CONDITION TO
LP’S OBLIGATIONS UNDER THIS WARRANTY AND THE FAILURE TO COMPLY
WITH ANY ONE OR MORE OF THE ITEMS SHALL VOID ANY RIGHTS PURCHASER
MAY HAVE AGAINST LP.
A. All claims under this Warranty must be sent in writing within 45 days after
the discovery of the nonconformity, and before beginning any permanent
repair, to: LP Warranty Claims Hwy 268 PO Box 98 Roaring River, NC 28669
B. All claims under this Warranty must be received by LP in writing no later
than one (1) year after the Product is purchased.
C. Purchaser must establish the date(s) the Product was purchased by retaining
any records which would tend to prove when the Product was purchased
including but not limited to: purchase invoices and receipts, contractor’s
billings, service contracts, and building permits.
D. Upon reasonable notice, the Purchaser must allow LP’s agents to enter the
Purchaser’s property to inspect the Product.
This Warranty gives you specific legal rights, and you may also have other rights
which vary from state to state.
9. Governing Law.
All questions concerning the meaning or applicability of this Limited Warranty
shall be decided under the laws of the State of Tennessee without reference to its
choice of law rules.
