•Thelackofconformityisaresultofanincorrectinstallation(exceptiftheinstallationhasbeen

carriedoutbyoneofSUNSTECH

sauthorizedsellersorunderitsresponsibility,orbytheconsumer

sinstallationinstructions)oranabusiveorinadequateuseoftheproduct,

includingbutnotlimitedto,ausagethatisnotinaccordancetothenormalpurposeoftheproduct

orthedirectionsforuseandmaintenance,asdefinedbySUNSTECH;

•Thelackofconformityhasbeencausedbyacomputervirus,anactionoramanipulationof

passwords,softwareinstallation,manipulationorreinstallation,etc.;

•Thelackofconformityisduetotheuseofaccessories,chargersorconsumablesthatarenot

SUNSTECHoriginalsandthereforearenotdesignedforthatproduct;

•Thelackofconformityisduetotheuseofanythirdpartysoftwareorapplicationthatmodifies,

changesoradaptsthesoftwarethatwasapprovedand/orincludedbySUNSTECHintheproduct;

•Thelackofconformityisaresultofdownloadingorusingthirdpartymultimediaservicesand/or

contentsavailableoraccessiblethroughtheproduct;

•Damagesinorthroughthebattery,whichareduetoitbeingovercharged,areproduced;

•Anyoftheboxsealsorbatterycellshavebeendamaged,orthereisclearevidencethatshowsthese

werehandled;and/or

•Theproductdamagesarecausedbyanyunforeseeableorforcemajeurcircumstances,especially,

lightning,water,fire,applyingincorrectvoltageoranyothercausethatisnotduetotheproduct

manufacturingordesign.

UndernocircumstanceswillSUNSTECHbeheldresponsibleforthelossofanydatastoredintheproduct.The

consumerwillbeheldresponsibleforanyback-upcopiesandtheprotectionofanydatafromloss,damageor

destruction.

Noneofthewarrantiesincludedherecoverthereplacementofparts,duetowareorruptureofmechanisms,

rubber,boxesand/orplastic,aswellasanyaestheticdamageresultingfromthenormaluseoftheproduct,for

example,ifthescreenlosesitsshinewiththeuseoftheproduct.Inthesameway,thewarrantiesdonotcover

anytypeofdamageproducedduringthetransportationoftheproduct (includingbutnotlimitedtoaesthetic

damage,blows,lines,scratches,stains,dents,etc.)inwhichcasetheapplicableprovisionsunderSUNSTECH

’

generalcontractconditionswillapply.
