S&P WARRANTY
THIS WARRANTY SUPERSEDES ALL PRIOR WARRANTIES
EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT,
THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, BY
OPERATION OF LAW OR OTHERWISE. S&P DISCLAIMS
THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE AS TO BOTH
S&P AND NON S&P PRODUCTS. S&P’S WARRANTIES
EXTEND SOLELY TO ITS CUSTOMER. S&P WILL NOT
BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL
OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT
LIMITED TO, LOSS OF USE, REVENUES, PROFITS OR
SAVINGS, EVEN IF S&P KNEW OR SHOULD HAVE KNOWN
OF THE POSSIBILITY OF SUCH DAMAGES.
EQUIPMENT WARRANTY AND
DISCLAIMERS
1. Subject to conditions (2) through (7) below, S&P warrants
that Equipment of its manufacture will be free from defects
in material and workmanship (exclusive of abrasion,
corrosion, or erosion) during the Warranty Period. During
the Warranty Period, S&P will repair or replace any
defective item of Equipment or part or component of
Equipment, promptly sent to S&P by Customer, which
S&P determines was defective due to faulty material or
workmanship. “Warranty Period” means the period stated
to be such based on the product type on page 78 of this
Price List or as otherwise indicated in this Price List
2. Because Equipment requires ongoing maintenance, the
preceding warranty is void if the maintenance specied by
S&P as required maintenance has not been performed, as
determined by S&P.
3. This Warranty is void if the S&P label control number or
date of manufacture, which is axed to the Equipment, has
been removed or altered in any way
4. This Warranty does not apply to damages from shipping,
either concealed or visible. Claim must be led with freight
company.
5. This Warranty does not apply to damages resulting from
improper wiring or installation
6. The Warranty does not apply to damages or failure caused
by acts of God, war, terrorism, riot, insurrection, or resulting
from improper consumer procedures, such as:
• Improper maintenance
• Misuse, abuse, abnormal use, or accident, and
• Incorrect electrical voltage or current.
7. This Warranty is in lieu of any other warranty, expressed,
implied or written, and to any consequential or incidental
damages, loss or property, revenues, or prot, or costs
of removal, installation or reinstallation, for any breach of
warranty.
8. The entire liability of S&P and Customer’s exclusive
remedy for any defective, non-S&P products provided
under this Agreement is limited to their return to S&P within
90 days after shipment for refund of the amount paid to
S&P for such products (not including any amounts paid for
related services.
TERMS & CONDITIONS OF SALE, cont.
FACTORY RETURN
1. Have a Return Materials Authorization (RMA) number. This
may be obtained by calling S&P at 800-961-7370. Please
have Bill of Sale available.
2. The RMA number must be clearly written on the outside of
the carton, or the carton will be refused.
3. All returned products must be shipped prepaid and be
accompanied with a copy of the Bill of Sale.
4. Product will be repaired/replaced and shipped back to
Buyer; no credit will be issued.
5. No eld repair costs or expenses are covered.
OR
The Distributor may place an order for the warranty part
and/or product and is invoiced. The Distributor will receive
a credit equal to the invoice only after product is returned
prepaid and veried to be defective.
S&P WARRANTY TERMS DO NOT PROVIDE FOR
REPLACEMENT WITHOUT CHARGE PRIOR TO
INSPECTION FOR A DEFECT. REPLACEMENTS ISSUED
IN ADVANCE OF DEFECT INSPECTION ARE INVOICED,
AND CREDIT IS PENDING INSPECTION OF RETURNED
MATERIALS. DEFECTIVE MATERIAL RETURNED BY
END USERS SHOULD NOT BE REPLACED BY THE
DISTRIBUTOR WITHOUT CHARGE TO THE END USER,
AS CREDIT TO DISTRIBUTOR’S ACCOUNT WILL
BE PENDING INSPECTION AND VERIFICATION OF
ACTUAL DEFECT BY S&P.
WARRANTY VALIDATION
1. The user must keep a copy of the Bill of Sale to verify
purchase date.
2. These warranties give you specic legal rights, and are
subject to any applicable consumer protection legislation.
3. You may have additional rights which vary from region to
region.
