personal watercraft so ld by authoriz ed BR P ("Distributors/Dealers") i n
member s t a tes of the European Economic Area ("EEA") (which is com prised of the
states mem ber of the European Union plus Norway, Iceland and Liechtens tein)
from defects in m ate rial or workm a ns hip for the period an d under the condi tions
described below. This lim ited warranty wil l bec ome null and void if: (1) the
Sea-Doo personal wat ercr aft w a s used for r a c ing or a ny o th er competitive activity,
at any point, even by a previous owner; or ( 2) the Sea-Doo personal wa tercraft ha s
been altered or modified in such a way so as to a dvers ely a ffect its op eration, per-
formance or durabi lity; (3) or has been altere d or modified to change its intended
use.
All genuine Sea-Doo personal watercraft parts and accessories, installed by an au-
thorized BR P Distributors/Dealers a t the time of delivery of the 2009 Sea-Doo per-
sonal watercraft c arry the sa m e warranty as that of t he pers onal watercraft.
2. LIMITATIONS OF LIABILITY
THIS WARRANTY IS EXPRESSLY GIVEN AN D ACCEPTED IN L IEU OF ANY
AND ALL OTHER WARRANTIE S, EX PRESSE D OR I MPLIED, INC LUD ING
WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT THAT THEY
CANNOT BE DISC LAIMED, THE IMPLIED WARRANTIES ARE LIMITED IN
DURATION TO THE LIFE OF THE EXPRESS WARRANTY. INCIDENTAL AND
CONSEQU ENTIAL DAMAGE S ARE EXCLUDED FROM C OVERAG E UN DER
THIS WARRANTY. SOME JURISDICTIONS DO NOT ALLOW FOR THE DIS-
CLAIMERS, LIMITATIONS AND EXCLUSIONS IDENTIFIED ABOVE, AS A
RESULT, THEY MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU
SPECIFIC RIGHTS, AN D YOU MAY ALSO HAVE OTHER LEGAL RIGHTS
WHICH MAY VARY FROM COUNTRY TO COUNTRY.
Neither the distributor, any B R P Distributor/Dealer nor an y other person has been
authorized to make any affirmation, representation or warranty regarding the
product, other than those containe d in this limited warranty, and if made, shall
not be enforceable against BRP. BRP reserves the right to modify this warranty
at any time, bei ng understood that such modification will not a lter the warranty
conditions a pplicable to the products sold while this warranty is in e ffect.
3. EXCLUSIONS – ARE NOT WARRANTED
The following are not w a rranted under a ny circumstances:
– Norm al wear and tear;
– Routine ma intenance i tem s, tune ups , adj us tm ents ;
– Dam a ge caused by fail ure to provide proper maintenanc e and /or storage , as de-
scribed in the Operator’s Guide;
– Dam a ge resulting from rem ov al of parts, i m proper repairs, service, mainte-
nance, mo difications or use of parts not manufa ct ured or approved by BRP or
resulting from repairs don e by a person that is not an a uthorized servicing BRP
Distributor/Dealer;
