PERSONAL WATERCRAFT
1. SCOPE
Bombardier Recrea tional Products I nc . ( “BRP”)* warrants its m odel year 2009
Sea-Doo pe rso na l watercra ft sold by a uthorized BRP distrib utors/deale rs (defin ed
below) outside of the fifty United States , C a na da and states me mbers of the
European Economic Area (which is com prised of the states member of the Eu-
ropean Union plus Norway, Iceland and Liechtenstein), w il l be free from defects
in material o r work m a nship for the period and under the conditions described
below. This limited warranty will become null and vo id if: (1) the Sea-Doo personal
watercraft was used for racing o r any other competitive activity, at any point, even
by a prev ious owner; or (2) the Sea- Doo personal waterc r a ft has been a ltered or
modified i n such a way so as to adversely a ffect its op eration, performance or
durability; (3) or has been altered or modified to chan ge its intend ed use.
All genuine BRP parts an d accessorie s, i ns talled by an au thorize d BRP
distributor/dealer a t the time of delivery of the 2 009 Se a-Doo personal waterc ra ft,
carry the same warranty a s that of the personal w ate rcraft.
2. LIMITATIONS OF LIABILITY
THIS WARRANTY IS EXPRESSLY GIVEN AN D ACCEPTED IN L IEU OF ANY
AND ALL OTHER WARRANTIE S, EX PRESSE D OR I MPLIED, INC LUD ING
WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT THAT THEY
CANNOT BE DISC LAIMED, THE IMPLIED WARRANTIES ARE LIMITED IN
DURATION TO THE LIFE OF THE EXPRESS WARRANTY. INCIDENTAL AND
CONSEQU ENTIAL DAMAGE S ARE EXCLUDED FROM C OVERAG E UN DER
THIS WARRANTY. SOME JURISDICTIONS DO NOT ALLOW FOR THE DIS-
CLAIMERS, LIMITATIONS AND EXCLUSIONS IDENTIFIED ABOVE, AS A
RESULT, THEY MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU
SPECIFIC RIGHTS, AN D YOU MAY ALSO HAVE OTHER LEGAL RIGHTS
WHICH MAY VARY FROM COUNTRY TO COUNTRY.
Neither the BRP distributor, any B RP dealer nor a ny other person ha s been autho-
rized to make a ny affirmation , representation or warranty regarding the product,
other than those c onta ined in this limited w arranty, a nd if mad e, shall not be en-
forceable against BRP. BRP reserves the right to m odify this warranty at any time,
being unders tood that suc h mod ification will not alter the warranty c onditi ons
applicable to the products sold w hile this wa rranty is in effe ct.
3. EXCLUSIONS
The following are not w a rranted under a ny circumstances:
– Norm al wear and tear;
– Routine ma intenance i tem s, tune ups , adj us tm ents ;
– Dam a ge caused by fail ure to provide proper maintenanc e and /or storage , as de-
scribed in the Operator’s Guide;
– Dam a ge resulting from rem ov al of parts, i m proper repairs, service, mainte-
nance, mo difications or use of parts not manufa ct ured or approved by BRP or
resulting from repairs don e by a person that is not an a uthorized servicing BRP
distributor/dealer;
