Limited Warranty
SIMERwarrantsto theoriginalconsumerpurchaser("Purchaser"or "You")ofitsproductsthattheyarefreefromdefectsinmaterialandworkmanship
for aperiodoftwelve(12)monthsfromthedateoftheoriginalconsumerpurchase.
If,withintwelve(12)monthsfromtheoriginalconsumerpurchase,anysuchproductshallproveto bedefective,it shallberepairedorreplacedat
SIMER'soption,subjecttothetermsandconditionssetforthbelow.Theoriginalpurchasereceiptandproductwarrantyinformationlabelarerequired
to determinewarrantyeligibility.Eligibilityis basedonpurchasedateof originalproduct- notthedateof replacementunderwarranty.Thewarrantyis
limitedto repairor replacementofproductonly- Purchaserpaysallremoval,installation,labor,shipping,andincidentalcharges.

Claimsmadeunderthiswarrantyshallbemadebyreturningtheproduct(exceptsewagepumps,seebelow)to theretailoutletwhereit waspurchased
immediatelyafterthediscoveryofanyallegeddefect.SIMERwill subsequentlytakecorrectiveactionaspromptlyasreasonablypossible.Norequests
for servicewill beacceptedif receivedmorethan30daysafterthewarrantyexpires.
Warrantydoesnotapplyto productsusedincommercial/rentalapplications.

DONOTreturnasewagepump(thathasbeeninstalled)to yourretailstore.ContactSIMERCustomerService.Sewagepumpsthathaveseenservice
andbeenremovedcarrya contaminationhazardwiththem.
Ifyoursewagepumphasfailed:

Youmustpayalllaborandshippingchargesnecessaryto replaceproductcoveredbythiswarranty.Thiswarrantydoesnotapplytothefollowing:(1)
actsof God;(2)productswhich,inSIMER'ssolejudgement,havebeensubjectto negligence,abuse,accident,misapplication,tampering,oralteration;
(3)failuresdueto improperinstallation,operation,maintenanceorstorage;(4)atypicalorunapprovedapplication,useorservice;(5)failurescaused
bycorrosion,rustorotherforeignmaterialsinthesystem,oroperationatpressuresinexcessof recommendedmaximums.
ThiswarrantysetsforthSIMER'ssoleobligationandpurchaser'sexclusiveremedyfor defectiveproducts.
SIMERSHALLNOTBELIABLEFORANYCONSEQUENTIAL,INCIDENTAL,ORCONTINGENTDAMAGESWHATSOEVER.
THEFOREGOINGWARRANTIESAREEXCLUSIVEANDINLIEUOFALLOTHEREXPRESSANDIMPLIEDWARRANTIES,INCLUDINGBUTNOTLIMITED
TOTHEIMPLIEDWARRANTIESOFMERCHANTABILITYANDFITNESSFORA PARTICULARPURPOSE.THEFOREGOINGWARRANTIESSHALLNOT
EXTENDBEYONDTHEDURATIONPROVIDEDHEREIN.
Somestatesdonotallowtheexclusionorlimitationofincidentalor consequentialdamagesorlimitationsonhowlonganimpliedwarrantylasts,so
theabovelimitationsorexclusionsmaynotapplytoYou.ThiswarrantygivesYouspecificlegalrightsandYoumayalsohaveotherrightswhichvary
