This limited warranty covers Shakertown® siding panels for a period of
25 years from the date of purchase when used on a structure which
conforms to local building codes and when installed in accordance with
the manufacturer's instructions and those described in the Uniform
Building Code. The warranty is limited to the original
purchaser/homeowner and may not be transferred to any subsequent
owner.
Subject to the limitations and exclusions set forth in this warranty,
Shakertown 1992, Inc. warrants to the original purchaser that the
Shakertown siding panels are free from manufacturing defects that
would adversely affect the normal performance of the siding. The pro-
rata warranty period for Shakertown siding panels is 25 years,
commencing upon purchase date.
Should the Shakertown siding panels be other than as warranted during
the warranty period, Shakertown 1992, Inc., at its sole option, will
repair, replace, or supply replacement panels for those panels that
Shakertown 1992, Inc. determines are defective by reason of a
manufacturing defect or refund a pro-rata portion of the amount the
original homeowner paid for the panels and shall not include any labor
charges. Refunds will be determined by pro-rating the original material
purchase price of the panels based upon the percentage of the
warranty period remaining.
This warranty does not apply to and Shakertown 1992, Inc. shall not be
liable for any damage to the siding, or any building components, or any
claims under this warranty if such damage or claim(s) arise out of, are
caused by or are in any way related to:
Any panels not used for normal wall applications or
mansards with a 60 degree slope or steeper.
The costs of any tear-off, installation, vents,
flashings, underlayments, fasteners or any other related materials.
Product failure caused by hurricane, tornado, lightning,
flood, fire, falling objects, civil commotion, or acts of God.
Product failure caused by settling, warping or
distortion of the building.
Product failure due to improper handling, use, or
maintenance, including the buildup of moss, dirt and other debris.
Product failure due to repairs or alterations of walls
after initial installation.
Shakertown siding panels are made from natural
wood, which will change and vary in color and hue, will naturally age
and weather.
Product failure caused by flashings, vents, under
layments, skylights, solar heating apparatus, paints, coatings, solutions,
or any other product not manufactured by Shakertown 1992, Inc.
The serviceable life of
siding materials may be affected by climate index, weather, installation
practices, improper maintenance, ventilation, underlayments and other
conditions which affect wear and tear. Shakertown 1992, Inc. is not
responsible for these factors causing product accelerated aging,
product fatigue, product failure or damage.
Any implied warranty of fitness for a particular use or purpose, and
warranty of merchantability, is limited In duration to the express
warranty provided herein unless a shorter period is permitted by law.
Shakertown 1992, Inc. shall not be liable for incidental or consequential
damages Or for damage to the building or its contents or its occupants.
This warranty contains all of the provisions of your remedies from
Shakertown 1992, Inc. The Shakertown 1992, Inc. liability Is limited to
the provisions of this warranty, whether any claim against it is based
upon strict liability, negligence, breach of warranty or other theory or
cause of action.
Some states do not allow limitations on how long an implied warranty
lasts or the exclusion of incidental or consequential damages, so the
above limitations may not apply to you.
Claims pursuant to this warranty must be submitted in writing, together
with proof of purchase, installation date, and records of maintenance, to
the Shakertown 1992, Inc. address set out below, within 30 days after
discovery of the defective panels. Shakertown 1992, Inc., within 120
days of notification, will investigate the claim. Shakertown 1992, Inc.
will not be liable for unauthorized replacement or the cost of
replacement incurred prior to written acknowledgment by Shakertown
1992, Inc. that it will replace the defective panels.

This Limited Warranty may not be changed or modified. This warranty
gives you specific legal rights and you may also have other rights which
vary from state to state.
