LIMITED WARRANTY:
American Valve warrants, to its initial purchaser only, that its ScaleRX Ion
Polarization System products which are delivered to the initial purchaser will
be the kind described in the order or price list and will be free from defects in
workmanship or material for a period of twelve (12) years from the date of delivery
to you, our initial purchaser. Should any failure to conform to this warranty appear
within twelve (12) years after the date of the initial delivery to our initial purchaser,
American Valve will, upon written notication thereof and substantiation that the
goods have been stored, installed, maintained and operated in accordance with
American Valve’s recommendation and standard industry practice, correct such
defects by suitable repair or replacement at American Valve’s own expense. If any
ScaleRX Ion Polarization System alleged to be defective, is returned to our factory
at Greensboro, NC, it will be examined and, if found to be defective under the
warranty, it will be replaced at no charge.

THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE OR OTHER WARRANTY OF QUALITY, WHETHER EXPRESS OR IMPLIED, EXCEPT THE WARRANTY OF
TITLE AND AGAINST PATENT INFRINGEMENT. Correction of
non-conformities, in the manner and for the period of time provided above, shall constitute fulllment of all liabilities of American Valve
to our initial purchaser, with respect to the goods, whether based on contract, negligence, strict tort or otherwise. It is the intention of
American Valve that no warranty of any kind, whether express or implied, shall pass through our initial purchaser to any other person or
corporation.
LIMITATION OF LIABILITY: American Valve SHALL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR SPECIAL OR
CONSEQUENTIAL DAMAGES SUCH AS, BUT NOT LIMITED TO, DAMAGES OR LOSS OF OTHER PROPERTY OR EQUIPMENT,
LOSS OF PROFITS, OR REVENUE, COST OF CAPITAL, COST OF PURCHASED OR REPLACEMENT GOODS, OR CLAIMS OF
CUSTOMERS OF OUR INITIAL PURCHASER. THE REMEDIES OF OUR INITIAL PURCHASER, AND ALL OTHERS, SET FORTH
HEREIN ARE EXCLUSIVE, AND THE LIABILITY OF AMERICAN VALVE WITH RESPECT TO SAME SHALL NOT, EXCEPT AS
EXPRESSLY PROVIDED HEREIN, EXCEED THE PRICE OF GOODS UPON WHICH SUCH LIABILITY IS BASED.
GARANTÍA LIMITADA:
American Valve garantiza, únicamente a su comprador inicial, que los productos del Sistema de polarización iónica ScaleRX que se entreguen al comprador inicial
serán los descritos en la orden o lista de precios y estarán libres de defectos de fabricación o material por un período de doce (12) años a partir de la fecha de
entrega a usted, nuestro comprador inicial.
En caso de que las fallas a esta garantía sucedan dentro de los doce (12) años posteriores a la fecha de la entrega a nuestro comprador inicial, American Valve,
después de la noticación por escrito de la misma y de la vericación de que la mercancía ha sido almacenada, instalada, mantenida y utilizada de acuerdo con las
recomendaciones de American Valve y las prácticas estándar industriales, corregirá dichos defectos mediante una reparación o sustitución adecuada por su cuenta.
Si cualquier Sistema de polarización iónica ScaleRX que presuntamente esté defectuoso, es devuelto a nuestra fábrica en Greensboro, NC, será revisado y, si se
encuentra defectuoso en virtud de la garantía, será reemplazado sin cargo alguno.
ESTA GARANTÍA ES EXCLUSIVA Y SUSTITUYE A CUALQUIER GARANTÍA IMPLÍCITA DE COMERCIALIZACIÓN, CONVENIENCIA PARA UN PROPÓSITO
ESPECÍFICO U OTRA GARANTÍA DE CALIDAD, TANTO EXPRESA COMO IMPLÍCITA, EXCEPTO LA GARANTÍA DE TÍTULO Y CONTRA LA VIOLACIÓN
DE PATENTE. La corrección de las inconformidades, en la manera y por el período de tiempo indicados anteriormente, constituirá el cumplimiento de todas
las responsabilidades de American Valve hacia nuestro comprador inicial, en relación con las mercancías, ya sea por contrato, negligencia, responsabilidad
extracontractual estricta o de otro tipo. La intención de American Valve es que ninguna garantía de ningún tipo, ya sea expresa o implícita, sea transmitida mediante
nuestro comprador inicial a ninguna otra persona o corporación.
LIMITACIÓN DE RESPONSABILIDAD: BAJO NINGUNA CIRCUNSTANCIA American Valve SERÁ RESPONSABLE POR DAÑOS ESPECIALES O DERIVADOS
TALES COMO, PERO SIN LIMITARSE A, DAÑOS O PÉRDIDA DE OTRAS PROPIEDADES O EQUIPOS, PÉRDIDA DE BENEFICIOS O INGRESOS, COSTO
DE CAPITAL, COSTO DE BIENES COMPRADOS O REEMPLAZADOS, O RECLAMACIONES DE LOS CLIENTES DE NUESTRO COMPRADOR INICIAL
LAS SOLUCIONES DE NUESTRO COMPRADOR INICIAL, Y TODOS LOS DEMÁS, ESTABLECIDOS EN ESTE DOCUMENTO SON EXCLUSIVAS, Y LA
RESPONSABILIDAD DE AMERICAN VALVE CON RESPECTO A LAS MISMAS NO EXCEDERÁ, SALVO QUE SE DISPONGA EXPRESAMENTE EN ESTE
DOCUMENTO, EL PRECIO DE LOS BIENES EN LOS QUE SE BASA DICHA RESPONSABILIDAD.
