• Red-M or its licensors retain ownership of the Software and no rights
are granted to you other than a license to use the Software on the
terms expressly set forth in this Agreement; the underlying design of
all Red-M hardware and the structure, sequence, organization and
source code of all Red-M software are valuable trade secrets of Red-
M or its licensors;
• the export of the Software and Hardware may be restricted by the
export control laws of the United States of America and other coun-
tries. You agree to comply with all such applicable export control
laws;
• without limiting the rights that the licensors or suppliers of Red-M
otherwise have to protect their intellectual property rights, each of
such licensors or suppliers are third party beneficiaries of this Agree-
ment for their respective products and may have the right to enforce
such terms against you;
• by using the Hardware and/or Software you hereby give explicit con-
sent for Red-M to process your personal data ("Personal Data") for
administrative, billing, marketing and support purposes, to include
the transfer of Personal Data inside and outside of the European Eco-
nomic Area (including, but not limited to, the USA). You agree that
Red-M may collect Personal Data from, or through your use of, the
Hardware and/or Software supplied to you by Red-M and from infor-
mation that you or your reseller supplies directly to Red-M. Red-M
acknowledges your rights in relation to Personal Data and will have
in place appropriate technical and organizational security measures
so as to ensure a level of security that is appropriate to the nature of
the data that is being processed. You may obtain further information
on your rights in relation to Personal Data by contacting Red-M's
Data Protection Compliance Officer at Wexham Springs, Framewood
Road, Wexham, Slough, SL3 6PJ, UK.
• the Software may contain or be derived from portions of code and
documentation provided by a third party under license to Red-M.
Red-M has assumed responsibility for the selection of such code and
documentation and its use in producing and licensing the Software.
ALL SUCH THIRD PARTIES DISCLAIMS ALL WARRANTIES WITH
RESPECT TO THE USE OF SUCH CODE OR DOCUMENTATION IN THE
SOFTWARE, INCLUDING (WITHOUT LIMITATION) ANY WARRANTIES
OF SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PUR-
POSE.
The limitation of liabilities described in this Agreement also applies to any
third-party supplier of code and documentation supplied to you. Red-M
and its third-party supplier limitations of liabilities are not cumulative.
Such third-party supplier is an intended beneficiary of this section. The
