(BrishColumbia)andanyamendmentsthereto,andthedeterminaonofsucharbitratorwillbenalandbinding

uponYouandRecon.ThearbitraonwillbeconductedintheEnglishlanguage.Ajudgmentontheawardofthe

arbitratormaybeenteredintoanycourthavingjurisdiconoverthepartyorparesagainstwhomanawardmay

beissuedandeachof Youand Reconagreestoandhereby waivesany defences againstthe enforceability and

execuonofanysuchjudgmentawardedbythearbitratoras contemplatedinthis LimitedWarranty.Judgment

ontheawardofanarbitratormaybeenteredbyanycourthavingjurisdiconoverthepersonorpropertyofthe

personagainstwhomenforcementofthejudgmentissought.Wherearbitraonisprohibitedbyapplicablelaws,

youandReconherebyagreetotheexclusivejurisdiconofthecourtsoftheprovinceofBrishColumbia,Canada

withrespecttoanyDisputesrelangtothisLimitedWarranty.

b. Anyarbitratorwillbeappointed,pursuanttoSubsecon9(a)above,byagreementbetweenYouandRecon

or,indefaultofagreement,sucharbitratorwillbeappointedbyaJudgeoftheSupremeCourtofBrishColumbia

singintheCourtsofVancouver,upontheapplicaonofeithersuchparty.

c. InanyarbitraonproceedingbetweenYouandRecon,itisagreedthatthepareswillbeentledtodiscovery

tothesameextentpermiedbytheSupremeCourtofBrishColumbiaasifthemaerwerebeingadjudicatedin

such Court.

d. Youherebywaiveallrightstoatrialbyjurywithrespecttoanyclaimsandissuesrelangtoorarisingoutof

thisLimitedWarranty.

 Youwaive(a)anyrighttoobjecttovenueorjurisdiconbasedoninconvenientforumorforany

otherreason;and(b)anystatutoryorotherrightpursuanttothelawsofthejurisdiconinwhichtheYouareresident

tohaveacourtcaseorarbitralhearingrelangtothisLimitedWarrantyadjudicatedorresolvedinthatjurisdicon.

Anyruleofinterpretaon,laworregulaonthatprovidesthatthelanguageofacontractwillbeinterpretedagainst

thedraerwillnotapplytothisLimitedWarranty.

 Governing Law.ThisLimitedWarrantywillbegovernedbyandinterpretedinaccordancewiththelawsofthe

ProvinceofBrishColumbiaandthefederallawsofCanadaasifmadeandperformedbyandbetweenparessituate

insuchprovinceandwithoutregardtotheconictoflawrulesthatwouldapplyadierentbodyoflaw.

   Each provision of this Limited Warranty is declared to be a separate and disnct promise

andtobeseparable fromall othersuchseparateanddisnctpromises.Ifanypromise,provisionor partthereof

isdeterminedbya courtofcompetentjurisdiconorotherconstutedlegalauthoritytobevoid,unenforceable

orunreasonableinwholeorinpart,itwillnotbedeemedtoaectorimpairtheenforceabilityorvalidityofany

otherpromiseorprovisioninthisLimitedWarrantyoranypartthereofandthesaidcourtorotherconstutedlegal

authoritywillhavetheauthoritytolimitsuchpromiseorprovisionasitdeemsproper.

 Waiver. ThefailurebyRecontoinsistonstrictcompliancewithanyprovisionofthesetermsandcondions

willnotbedeemedtobeawaiverofsuchprovision,andawaiverofanyprovisionofthesetermsandcondionsat

anyonemeormeswillnotbedeemedtobeawaiverforanyotherme.ThefailureofRecontoassertitsrights

inamelyfashionforanyofitsrightsorremediesunderthesetermsandcondionswillnotbeinterpretedasa

Warrantyinformaon
