LED Lighting Limited Warranty
When properly installed and under normal conditions of use, Progress Lighting, Inc. (“Progress Lighting”) warrants its light emitting diode (LED) lighting products, including the LED
arrays and the LED drivers ("Product(s)") to be free from defects in material and workmanship for a period of five (5) years from the date of shipment of such Products to the first buyer
(as herein defined). The LED arrays in the Product(s) will be considered defective in material or workmanship only if a total of 10% or more of the individual LED’s in the Product(s) fail
to illuminate. Buyer agrees to make all claims regarding defects or deficiencies according to the warranty of the manufacturer as its sole source of recourse or compensation. No labor,
installation, or removal charges are included in this warranty unless approved in writing by Progress Lighting prior to such implementation. Contact Progress Lighting Field Services for

Progress Lighting's warranty shall extend only to the first Buyer of a product from Progress Lighting, from Progress Lighting's Buyer, or from an original equipment manufacturer
reselling Progress Lighting's product, and is non-assignable and non-transferable and shall be of no force and effect if asserted by any person other than such first Buyer (“Buyer”).
Any claim by Buyer for breach of the foregoing warranty shall be deemed waived by Buyer unless submitted to Progress Lighting in writing within thirty (30) days from the date Buyer
discovered, or by reasonable inspection should have discovered the alleged breach. Any cause of action for breach of the foregoing warranty shall be brought within the warranty
period after the cause of action has occurred.
Progress Lighting may repair or replace any Product(s) covered by this warranty in its sole discretion and in accordance with its procedure. Any unauthorized return, repair,
replacement or modification of the Product(s) shall void this warranty. This warranty applies only to the use of the Product(s) as intended by Progress Lighting and does not cover any
misapplication or misuse of said Product(s). All product specifications are subject to change without prior notice. Progress Lighting does not warrant defects or damage caused by
failure to provide a suitable installation environment and ambient temperature as stated in the product specification sheet; acts of God including but not limited to lightning surges,
flooding, earthquakes, or any other cause beyond its control; any primary side (line voltage) power source problem including, but not limited to, unregulated power, short circuits, or
power surges. During the Warranty period some staining, chalking or fading may occur. This is normal aging of the finish and is not a manufacturing defect, therefore it is not covered
by this warranty. Neither polycarbonate nor acrylic material used in the Products is warranted against yellowing as this change may naturally occur over time due to normal aging.
The Buyer's exclusive remedy for breach of the warranty shall be the repair or replacement, F.O.B. factory, at Progress Lighting’s option, of any Product found to be defective under
the warranty, which is returned to Progress Lighting within the applicable warranty period as noted. Progress Lighting shall neither honor nor be responsible for any warranties,
services, repairs, replacements, representations, or commitments made by any person or entity other than Progress Lighting with respect to the Product(s). Warranty claims should be
sent to Progress Lighting, 701 Millennium Boulevard, Greenville, SC 29607. Product(s) may be returned only after a Return Authorization Number has been issued by Progress
Lighting's customer service department.
APPLICATION: Progress Lighting does not warrant the accuracy of and results from product or system performance recommendations resulting from any engineering analysis or
study. This applies regardless of whether a charge is made for the recommendation, or if it is provided free of charge. Responsibility for selection of the proper product or application
rests solely with the Buyer. In the event that errors or inaccuracies are determined to be caused by Progress Lighting, its liability will be limited solely to the re-performance of any
such analysis or study. Products should be installed, used and maintained in accordance with the applicable Progress Lighting instructions, national electrical codes and/or any
prevailing local codes. Any modification to the Product(s) will void this warranty, as well as any U.L., CSA or other agency listings.

LIMITATION OF LIABILITY:
IN NO EVENT, WHETHER, AS A RESULT OF A BREACH OF CONTRACT, TORT, STRICT LIABILITY, WARRANTY OR ALLEGED NEGLIGENCE, SHALL PROGRESS LIGHTING
BE LIABLE TO BUYER FOR ANY INDIRECT, SPECIAL, INCIDENTAL, MULTIPLE, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED
TO, LOSS OF PROFITS OR REVENUE, LOSS OF USE OF THE EQUIPMENT OR ANY ASSOCIATED EQUIPMENT, LOSS OF CAPITAL, COST OF SUBSTITUTE EQUIPMENT,
FACILITIES OR SERVICES, DOWNTIME COSTS, OR CLAIMS OF THIRD PARTIES OF THE BUYER FOR SUCH DAMAGES. IN NO EVENT SHALL PROGRESS LIGHTING'S
TOTAL LIABILITY FOR ANY REASON ARISING HEREUNDER EXCEED THE PURCHASE PRICE PAID TO PROGRESS LIGHTING FOR THE PRODUCT(S) PURCHASED BY
BUYER HEREUNDER.
NO ADDITIONAL WARRANTIES:
PROGRESS LIGHTING HEREBY SPECIFICALLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND THE
SERVICES CONTEMPLATED IN THIS WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF NO INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE, OR IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
Iluminación LED Garantía limitada
Cuando está correctamente instalado y funcionando en condiciones normales de uso, Progress Lighting, Inc. (en lo sucesivo, Progress Lighting) garantiza que sus productos de
diodos de emisión de luz (LED), incluyendo sus matrices de LED y sus unidades LED [en lo sucesivo, producto(s)], no presentarán defectos en los materiales y en la mano de obra
durante un periodo de cinco (5) años a partir de la fecha de envío del producto al primer comprador (de conformidad con lo definido en el presente documento). Se considerará que
las matrices de LED de los productos presentan defectos en sus materiales o en la mano de obra solo si un total del 10% o más de los LED individuales del producto no se iluminan.
El comprador se compromete a realizar todos los reclamos relacionados con los defectos o deficiencias de conformidad con la garantía del fabricante, siendo este su única fuente de
recurso o compensación. En esta garantía no se incluye ningún costo de mano de obra, instalación ni retirada, a menos que Progress Lighting lo apruebe por escrito antes de tal

La garantía de Progress Lighting será solo de aplicación para el primer comprador de un producto de Progress Lighting, de un comprador de Progress Lighting o de un fabricante de
dispositivos originales que revendan productos de Progress Lighting; no se puede asignar ni transferir y no tendrá ninguna validez si es una persona distinta del primer comprador (en
lo sucesivo, comprador) la que efectúa el reclamo. Cualquier reclamo del comprador por el incumplimiento de la garantía anterior se considerará no válido por el comprador a menos
que se presente ante Progress Lighting por escrito en un periodo de treinta (30) días a partir de la fecha en que el comprador descubriera o, mediante una inspección razonable
hubiera descubierto, el presunto incumplimiento. Cualquier motivo de acción por el incumplimiento de la garantía anterior se presentará dentro del periodo de garantía luego de que
suceda el motivo de acción.
Progress Lighting puede reparar o sustituir cualquier producto cubierto por esta garantía a su única discreción y de conformidad con su procedimiento. Cualquier devolución,
reparación, sustitución o modificación del producto que no haya sido autorizada anulará esta garantía. Esta garantía se aplica solo al uso del producto como estipula Progress
Lighting y no cubre ningún uso ni aplicación inadecuados de dicho producto. Todas las especificaciones del producto están sujetas a cambios sin previo aviso. Progress Lighting no
brinda ninguna garantía por los defectos o daños causados por no proporcionar un entorno de instalación y una temperatura ambiente que sean adecuados según queda estipulado
en la hoja de especificaciones del producto; catástrofes naturales, entre las que se encuentran, pero sin limitación, las sobretensiones por rayos, las inundaciones, los terremotos o
cualquier otra causa fuera de su control; cualquier problema de alimentación de lado primario (línea de tensión), entre los que se encuentran, pero sin limitación, las fuentes de
alimentación no reguladas, los cortocircuitos o las sobretensiones de energía. Podrían producirse indicios de desteñido, manchas o marcas durante el periodo de garantía. Es el
envejecimiento natural del acabado y no es un defecto de fabricación, por lo tanto, no queda cubierto por la garantía. Ni el policarbonato ni el material acrílico empleado en el
producto están garantizados frente al amarilleamiento, ya que este cambio podría suceder naturalmente con el tiempo, debido al envejecimiento normal.
El único recurso del comprador en caso de incumplimiento de la garantía será la reparación o la sustitución, libre de cargo desde la fábrica, a elección de Progress Lighting, de
cualquier producto que se encuentre defectuoso de conformidad con la garantía y que se devuelva a Progress Lighting dentro del periodo de garantía aplicable según lo establecido.
Progress Lighting no tiene la obligación de cumplir ni tiene la responsabilidad de ninguna garantía, ni servicio, reparación, sustitución, representación ni compromiso realizados por
