Warranty is valid unless it is made in writing and
signedbyanauthorisedrepresentativeof Oricom.
Oricomwillnotbeinbreachofawarrantyexpressly
set out in this User Guide or under the Competition
andConsumerAct2010andexcludesanyliability
for damages or any other remedy arising under any
other legislation or the common law if the damage
occurs as a result of:
1.failurebyyoutoadheretothewarningsandfollow
the instructions set out in this user guide for the
proper installation and use of the product;
2.negligenceonyourpart or misusebyyouofthe
product;
3.anuncontrollableexternalcausewhichresultsin
theproductnotfunctioningincludingbutnotlimitedto
powerfailure,lightningorovervoltage;and
4.modicationtotheproductorservicescarriedout
ontheproductionbyanyoneotherthanOricomor
Oricom’sauthorisedserviceprovider.
Oricomwillnotbeliableforanydamagescausedby
theproductorthe failure oftheproducttoperform,
includinganylostprofitsorsavingsorspecial,
incidentalorconsequentialdamages.Oricomisnot
liableforany claim madebyathirdpartyormade
byyouonbehalfof a thirdparty.Thislimitationof
liabilityapplieswhetherdamagesaresought,ora
claimmade,underthisWarrantyorasatortclaim
(includingnegligenceandstrictproductliability),
acontractclaimoranyotherclaim.However,this
limitationofliabilitywillnotapplytoclaimsfor
personalinjury.NothinginthisWarranty excludes,
restrictsormodifiesanycondition,warranty,right
or remedy which pursuant to the Competition and
Consumer Act 2010 applies to this Warranty and
whichmaynotbesoexcluded,restrictedormodied.
Forwarrantiesthatcannotbe excluded, restricted
ormodied,Oricomlimitstheremediesavailableto
thosespeciedintherelevantlegislation.
