4.Breakageordamagetoantennasunlesscauseddirectlyby
defectsinmaterialworkmanship.
5.AProductsubjectedtounauthorizedProductmodications,
disassemblesorrepairs(including,withoutlimitation,
theadditiontotheProductofnon-MOTOROLAsupplied
equipment)whichadverselyaffectperformanceofthe
ProductorinterferewithMOTOROLA'snormalwarranty
inspectionandtestingoftheProducttoverifyanywarranty
claim.

timetheProductwasinitiallydistributedfromMOTOROLA.

thatdoesnotaffecttheoperationoftheProduct.
11.Normalandcustomarywearandtear.
VI.PATENTANDSOFTWAREPROVISIONS:
MOTOROLAwilldefend,atitsownexpense,anysuitbrought
againsttheenduserpurchasertotheextentthatitisbased
onaclaimthattheProductorpartsinfringeaUnitedStates
patent,andMOTOROLAwillpaythosecostsanddamages
nallyawardedagainsttheenduserpurchaserinanysuchsuit
whichareattributabletoanysuchclaim,butsuchdefenseand
paymentsareconditionedonthefollowing:
1.thatMOTOROLAwillbenotiedpromptlyinwritingbysuch
purchaserofanynoticeofsuchclaim,
2.thatMOTOROLAwillhavesolecontrolofthedefense
ofsuchsuitandallnegotiationsforitssettlementor
compromise,and
3.shouldtheProductorpartsbecome,orinMOTOROLA’s
opinionbelikelytobecome,thesubjectofaclaimof
infringementofaUnitedStatespatent,thatsuchpurchaser
willpermitMOTOROLA,atitsoptionandexpense,either
toprocureforsuchpurchasertherighttocontinueusing
