Sujeta a las exclusiones que se describen más abajo, por un período (como se define debajo) desde la fecha de entrega por parte de Lutron, Lutron garantiza que
cada nuevo producto (“Producto”), estará libre de defectos de fabricación. Lutron decidirá, a su propia voluntad, reparar las piezas defectuosas o proveer piezas
de repuesto comparables en tanto Lutron sea notificada en seguida del defecto, dentro del período de garantía (como se define debajo). Las piezas de reemplazo
provistas por Lutron pueden ser nuevas, usadas, reparadas, reacondicionadas, y/o fabricadas por un tercero.
EXCLUSIONES A LA GARANTÍA LIMITADA
Esta Garantía no cubre, y Lutron y sus proveedores no son responsables por:
1. Daño, mal funcionamiento o inoperabilidad diagnosticada por Lutron o por un tercero autorizado por Lutron, causado por el envejecimiento normal, abuso, mal uso,
instalación incorrecta, negligencia, accidente o interferencia de fuentes u obstáculos de radio frecuencia o infrarrojos, como, pero no limitados a (a) el uso de voltajes
de línea, fusibles o cortacircuitos incorrectos; (b) falla de la instalación, mantenimiento y operación del Producto, por no cumplir con las instrucciones de operación
suministradas por Lutron y los requisitos aplicables del National Electrical Code y de los Estándares de Seguridad de Underwriter’s Laboratories; (c) el uso de dis-
positivos o accesorios incompatibles; (d) fallas en el mantenimiento del equipo bajo temperatura ambiente adecuada; (e) reparaciones o ajustes no autorizados; (f)
vandalismo; y (g) por un acto de Dios, como fuego, descargas eléctricas, inundaciones, tornado, terremoto, huracán u otros problemas que escapen al control de
Lutron.
2. Los costos del trabajo en sitio para diagnosticar, y la remoción, reparación, ajuste, reinstalación y/o reprogramación del Producto, a sola elección de Lutron, todos
los cuales serán pagos por el Cliente al precio del momento del servicio.
3. Donde sea aplicable, los componentes y equipos externos al Producto, como lámparas; balastos que no sean de Lutron, zócalos, y artefactos; el cableado de los
artefactos entre los balastos y las lámparas; la construcción del cableado entre los atenuadores o paneles de atenuadores y las lámparas y entre los controles y con-
troles, atenuadores o paneles de atenuadores; y otros equipos de fabricantes no provistos por Lutron, como relojes temporizadores; equipo audio-visual; detectores
de movimiento; sensores fotoeléctricos; sensores de entrada de coches; almohadillas de presión; cortinas; y spas.
4. El costo de reparar o reemplazar otros bienes que se hayan dañado por el mal funcionamiento del Producto, aunque el daño haya sido provocado por el Producto
ESTA GARANTÍA REEMPLAZA A TODAS LAS OTRAS GARANTÍAS EXPRESAS. TODAS LAS GARANTÍAS IMPLÍCITAS, INCLUYENDO GARANTÍAS
IMPLÍCITAS DE COMERCIABILIDAD O ADECUACIÓN A UN PROPÓSITO PARTICULAR, ESTÁN LIMITADAS A UN AÑO A PARTIR DE LA FECHA DE
ENTREGA.
NINGÚN AGENTE, EMPLEADO O REPRESENTANTE DE LUTRON TIENE AUTORIDAD PARA COMPROMETER A LUTRON CON NINGUNA AFIRMACIÓN,
DECLARACIÓN O GARANTÍA RESPECTO DEL PRODUCTO. A MENOS QUE UNA AFIRMACIÓN, DECLARACIÓN O GARANTÍA REALIZADA POR UN
AGENTE, EMPLEADO O REPRESENTANTE ESTÉ INCLUIDA ESPECÍFICAMENTE AQUÍ, O EN EL MATERIAL IMPRESO ESTÁNDAR PROVISTO POR
LUTRON, NO FORMARÁ PARTE DE LA BASE DE NINGUNA NEGOCIACIÓN ENTRE LUTRON Y EL CLIENTE Y NO PODRÁ SER EXIGIDA DE NINGUNA
MANERA POR EL CLIENTE.
EN NINGÚN CASO SERÁ RESPONSABLE LUTRON NI NINGUNA OTRA PARTE, POR DAÑOS EJEMPLARES, CONSECUENTES, INCIDENTALES
O ESPECIALES (INCLUYENDO, PERO SIN LIMITARSE A DAÑOS POR HERIDAS PERSONALES, FALLA EN EL CUMPLIMIENTO DE UNA TAREA,
INCLUYENDO LA BUENA FE O EL CUIDADO RAZONABLE, NEGLIGENCIA O CUALQUIER OTRA PÉRDIDA), NI POR NINGÚN TRABAJO DE REPARACIÓN
REALIZADO SIN EL CONSENTIMIENTO PREVIO EXPRESO POR ESCRITO DE LUTRON, QUE SURJA O ESTÉ RELACIONADO EN ALGUNA FORMA CON
LA INSTALACIÓN, USO O IMPOSIBILIDAD DE USO DEL PRODUCTO, O DE OTRA MANERA, BAJO O EN CONEXIÓN A CUALQUIER PROVISIÓN DE ESTA
GARANTÍA, AÚN EL CASO DE FALLA, AGRAVIO INDEMNIZABLE (INCLUYENDO NEGLIGENCIA), RESPONSABILIDAD ESTRICTA, INDEMNIZACIÓN O
CONTRATO DE INDEMNIZACIÓN DE GARANTÍA DE LUTRON O CUALQUIER PROVEEDOR, AÚN SI LUTRON U OTRA PARTE HABÍAN SIDO AVISADOS DE
LA POSIBILIDAD DE TALES DAÑOS.
SIN PERJUICIO DE CUALQUIER DAÑO QUE PUEDA SUFRIR EL CLIENTE POR CUALQUIER RAZÓN (INCLUYENDO, PERO SIN LIMITARSE A, TODOS
LOS DAÑOS DIRECTOS Y TODOS LOS ENUMERADOS MÁS ARRIBA), LA RESPONSABILIDAD DE LUTRON Y DE TODOS LOS TERCEROS BAJO ESTA
GARANTÍA EN CUALQUIER RECLAMO DE DAÑOS QUE SURJA EN RELACIÓN CON LA FABRICACIÓN, INSTALACIÓN, ENVÍO, USO, REPARACIÓN O
REEMPLAZO DEL PRODUCTO, Y LA ÚNICA COMPENSACIÓN POR LO ANTERIOR, SE LIMITARÁ AL TOTAL PAGADO A LUTRON POR EL CLIENTE
POR EL PRODUCTO. LAS LIMITACIONES, EXCLUSIONES Y CLÁUSULAS EXONERATIVAS ANTERIORES SE APLICARÁN CON EL MÁXIMO ALCANCE
PERMITIDO POR LA LEY APLICABLE, INCLUSO SI LA COMPENSACIÓN NO CUMPLE CON SU PROPÓSITO ESENCIAL.

años, pero no más de 5 años – 50%; más de 5 años, pero no más de 8 años – 25%; más de 8 años – 0%.
Clear Connect Enabled : 1 año desde el día de la entrega de Lutron. Válido sólo para modelos con Clear Connect Enabled que comienzen con CCD.

Assujettie aux exclusions décrites plus bas, pour une période (comme définie ci-dessous) après l’expédition par Lutron, Lutron garantie que chaque nouveau produit
(« Produit ») sera libre de tout défaut de fabrication. Lutron, à sa propre option, réparera la pièce défectueuse ou procurera une pièce de remplacement comparable si
Lutron est promptement avisé du défaut en dedans de la période de garantie (comme définie ci-dessous). Les pièces de remplacement fournies par Lutron pourront
être neuves, usagées, réparées, remises en état et/ou d’un fabricant différent.
EXCLUSIONS À LA GARANTIE LIMITÉE
Cette garantie ne couvre pas, et Lutron et ses fournisseurs ne sont aucunement responsable pour :
1. Les dommages, mauvais ou non fonctionnement diagnostiqués par Lutron ou une tierce partie approuvée par Lutron comme étant due à l’usure normale, l’abus, la
mauvaise utilisation, une mauvaise installation, la négligence, un accident ou de l’interférence radio ou une source d’infrarouge ou obstacles comme, mais non limités
à : a) la mauvaise tension de ligne, l’utilisation de disjoncteur ou fusibles de classe/calibre inadéquats; b) le manquement d’installer, maintenir le Produit selon les
instructions d’opération fournies par Lutron et les sections applicables du Code de l’Électricité et normes de sécurité de Underwriter’s Laboratories; c) l’utilisation sur
des dispositifs ou avec des accessoires incompatibles; d) le manquement de garder l’équipement en dedans de la plage de température spécifiée; e) les réparations
ou réglages non autorisés; f) le vandalisme; et g) les situations de force majeure telles les incendies, la foudre, les inondations, les avaries causées par les ouragans
et tornades, les tremblements de terre ou tout autre événement hors du bon vouloir de Lutron.
2. Les frais de personnel de service pour diagnostiquer les problèmes aux sites incluant les travaux de retrait, réparation remplacement réglage, réinstallation et/ou
re-programmation du Produit selon la décision de Lutron, qui devra être payé dans son entier par le client au taux de service en vigueur.
3. Lorsque applicable, les composants et équipements externes au Produit, tels les ampoules, les ballasts douilles et luminaires d’autres marques que Lutron; le câblage
électrique entre les gradateurs ou entre les panneaux de commandes et les lumières ou entre les commandes entre elles, gradateurs et panneaux de commandes
et les équipements d’autres fabricants non fournis par Lutron tels les horloges à poinçon, équipements audiovisuel, détecteurs d’occupation, photo détecteurs,
détecteurs d’entrée pour automobiles, cellules à capteur de pression, stores, et spas.
4. Le coût de réparation ou de remplacement d’autres biens endommagés parce que le Produit ne fonctionne pas correctement, même si le dommage est causé par le
Produit.
CETTE GARANTIE REMPLACE TOUTE AUTRE GARANTIE EXPRESSE ET TOUTES LES GARANTIES IMPLICITES INCLUANT LES GARANTIES IMPLICITES
DE QUALITÉ MARCHANDE ET DE CONVENANCE PARTICULIÈRE ET EST LIMITÉE À UN AN DE LA DATE D’EXPÉDITION.
AUCUN AGENT DE LUTRON, EMPLOYÉ OU REPRÉSENTANT N’A L’AUTORISATION DE LIER LUTRON À UNE AFFIRMATION QUELCONQUE,
REPRÉSENTATION OU DE GARANTIE CONCERNANT LE PRODUIT SAUF SI UNE AFFIRMATION, REPRÉSENTATION OU GARANTIE FAITE PAR L’AGENT,
L’EMPLOYÉ OU LE REPRÉSENTANT EST SPÉCIFIQUEMENT INCLUSE CI-APRÈS, OU INCLUSE À LA LITTÉRATURE IMPRIMÉE FOURNIE PAR LUTRON,
CECI NE FAIT AUCUNEMENT PARTIE DES BASES DE TOUTE NÉGOCIATION ENTRE LE CLIENT ET NE SERA AUCUNEMENT EXIGEABLE PAR LE CLIENT.
EN AUCUN CAS LUTRON OU TOUTE AUTRE PARTIE NE SERA RESPONSABLE DE DOMMAGES ACCESSOIRES, INDIRECTS, EXEMPLAIRES OU
SPÉCIAUX (INCLUANT SANS ÊTRE LIMITÉS AUX BLESSURES DE PERSONNEL, DÉFAUT DE COMPLÉTER UN MANDAT INCLUANT BONNE FOI OU
PRÉCAUTIONS RAISONNABLES, NÉGLIGENCE OU TOUTE AUTRE PERTE QU’ELLE QUELLE SOIT) NON PLUS POUR TOUTE RÉPARATION ENTREPRISE
SANS LE CONSENTEMENT ÉCRIT DE LUTRON ET RELATIF DE TOUTE FAÇON À L’INSTALLATION, DÉSINSTALLATION, UTILISATION OU INCAPACITÉ
D’UTILISATION DU PRODUIT OU D’AUTRE FAÇON SOUS PROVISION OU EN RELATION AVEC TOUTE PROVISION DE CETTE GARANTIE MÊME EN CAS
DE DÉFAUT, TORT (INCLUANT LA NÉGLIGENCE) LA RESPONSABILITÉ STRICTE, LE BRIS DE CONTRAT OU BRIS DE GARANTIE DE LUTRON OU DE
TOUT FOURNISSEUR ET MÊME SI LUTRON OU TOUT AUTRE PARTIE AVAIENT ÉTÉ AVISÉS DE LA POSSIBILITÉ DE CES DOMMAGES.
NONOBSTANT TOUT DOMMAGE QUI POURRAIT SURVENIR, POUR N’IMPORTE QUELLE RAISON (INCLUANT SANS LIMITATION, TOUS DOMMAGES
DIRECTS ET TOUS DOMMAGES ÉNUMÉRÉS CI-DESSUS), LA RESPONSABILITÉ ENTIÈRE DE LUTRON ET DE TOUT AUTRE PARTI AUX TERMES
DE CETTE GARANTIE SUR TOUTE RÉCLAMATION POUR DOMMAGES SURVENANT EN DEHORS DE OU EN RAPPORT AVEC LA FABRICATION,
VENTE, INSTALLATION, LIVRAISON, UTILISATION, RÉPARATION, OU REMPLACEMENT DU PRODUIT, OU TOUTE ENTENTE INCORPORANT CETTE
GARANTIE, ET LE SEUL RECOURS DÉJÀ CITÉ POUR LE CLIENT, SERA LIMITÉ AU MONTANT PAYÉ À LUTRON PAR LE CLIENT POUR LE PRODUIT. LES
LIMITATIONS SUSDITES, EXCLUSIONS ET RENONCIATIONS SERONT AU MAXIMUM DANS LA MESURE ALLOUÉE APPLICABLE PAR LA LOI, MÊME SI
TOUT RECOURS ÉCHOUE SON BUT ESSENTIEL.

Subject to the exclusions described below, for a period (as defined below) after the date of shipment by Lutron, Lutron warrants each new product (“Product”) to be
free from manufacturing defects. Lutron will, at its option, repair the defective part or provide comparable replacement parts so long as Lutron is promptly notified of
the defect within the warranty period (as defined below). Replacement parts provided by Lutron may be new, used, repaired, reconditioned, and/or made by a different
manufacturer.
EXCLUSIONS TO LIMITED WARRANTY
This Warranty does not cover, and Lutron and its suppliers are not responsible for:
1. Damage, malfunction or inoperability diagnosed by Lutron or a Lutron approved third party as caused by normal wear and tear, abuse, misuse, incorrect installation,
neglect, accident, or interference from radio frequency or infrared sources or obstacles, such as, but not limited to (a) use of incorrect line voltages, fuses or circuit
breakers; (b) failure to install, maintain and operate the Product pursuant to the operating instructions provided by Lutron and the applicable provisions of the National
Electrical Code and of the Safety Standards of Underwriter’s Laboratories; (c) use of incompatible devices or accessories; (d) failure to maintain equipment under
specified ambient temperature; (e) unauthorized repairs or adjustments; (f) vandalism; and (g) an act of God, such as fire, lightning, flooding, tornado, earthquake,
hurricane or other problems beyond Lutron’s control.
2. On-site labor costs to diagnose issues with, and remove, repair, replace, adjust, reinstall and/or reprogram the Product, at Lutron’s option, all of which will be paid by
Customer at the then current service price.
3. Where applicable, components and equipment external to the Product, such as, lamps; non-Lutron ballasts, sockets, and fixtures; fixture wiring between ballasts
and lamps; building wiring between dimmers or dimmer panels and lamps and between controls and controls, dimmers or dimmer panels; and other manufacturers’
equipment not provided by Lutron, such as time clocks; audio-visual equipment; motion detectors; photosensors; driveway sensors; pressure pads; shades; and spas.
4. The cost of repairing or replacing other property that is damaged when the Product does not work properly, even if the damage was caused by the Product.
THIS WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO ONE YEAR FROM THE DATE OF SHIPMENT.
NO LUTRON AGENT, EMPLOYEE OR REPRESENTATIVE HAS ANY AUTHORITY TO BIND LUTRON TO ANY AFFIRMATION, REPRESENTATION OR
WARRANTY CONCERNING THE PRODUCT. UNLESS AN AFFIRMATION, REPRESENTATION OR WARRANTY MADE BY AN AGENT, EMPLOYEE OR
REPRESENTATIVE IS SPECIFICALLY INCLUDED HEREIN, OR IN STANDARD PRINTED MATERIALS PROVIDED BY LUTRON, IT DOES NOT FORM A PART
OF THE BASIS OF ANY BARGAIN BETWEEN LUTRON AND CUSTOMER AND WILL NOT IN ANY WAY BE ENFORCEABLE BY CUSTOMER.
IN NO EVENT WILL LUTRON OR ANY OTHER PARTY BE LIABLE FOR EXEMPLARY, CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES (INCLUDING,

STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF LUTRON OR ANY SUPPLIER, AND EVEN IF LUTRON OR ANY OTHER PARTY
WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANY DAMAGES THAT CUSTOMER MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL
DIRECT DAMAGES AND ALL DAMAGES LISTED ABOVE), THE ENTIRE LIABILITY OF LUTRON AND OF ALL OTHER PARTIES UNDER THIS WARRANTY
ON ANY CLAIM FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE MANUFACTURE, SALE, INSTALLATION, DELIVERY, USE, REPAIR,
OR REPLACEMENT OF THE PRODUCT, AND CUSTOMER’S SOLE REMEDY FOR THE FOREGOING, WILL BE LIMITED TO THE AMOUNT PAID BY
CUSTOMER FOR THE PRODUCT. THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS WILL APPLY TO THE MAXIMUM EXTENT ALLOWED

Clear Connect Enabled : 1 year after date of shipment by Lutron. Valid only for Clear Connect Enabled model numbers beginning with ‘CCD’.
