5. LIMITATION OF REMEDIES AND DAMAGES: COVIDIEN’S ENTIRE LIABILITY TO
YOU FOR ACTUAL DAMAGES FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF
THE FORM OF THE ACTION, AND YOUR EXCLUSIVE REMEDY SHALL BE LIMITED TO
THE MONEY PAID FOR THE SYSTEM, WHICH INCLUDED THE LICENSED SOFTWARE.
IN NO EVENT SHALL COVIDIEN BE LIABLE TO YOU (i) FOR ANY INCIDENTAL,
CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING DAMAGES FOR LOSS OF
BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND
THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE ANY LICENSED
SOFTWARE EVEN IF COVIDIEN OR ANY AUTHORIZED COVIDIEN REPRESENTATIVE HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (ii) FOR ANY CLAIM BY
ANY OTHER PARTY.
6. OPEN SOURCE SOFTWARE DISCLOSURE
 This document identifies the Open Source Software that may be separately
called, executed, linked, affiliated, or otherwise utilized by this product.
 Such Open Source Software is licensed to users subject to the terms and
conditions of the separate software license agreement for such Open Source
Software.
 Use of the Open Source Software by you shall be governed entirely by the terms
and conditions of such license.
