52.227‐19(a)through(d)oftheCommercialComputerSoftware‐RestrictedRightsClauseanditssuccessors,and(iii)in
allrespectsisproprietarydatabelongingtoEnterasysand/oritssuppliers.ForDepartmentofDefenseunits,the
ProductisconsideredcommercialcomputersoftwareinaccordancewithDFARS
section227.7202‐3anditssuccessors,
anduse,duplication,ordisclosurebytheGovernmentissubjecttorestrictionssetforthherein.
10. LIMITEDWARRANTYANDLIMITATIONOFLIABILITY.TheonlywarrantyEnterasysmakestoYouin
connectionwiththislicenseoftheLicensedMaterialsisthatifthemediaonwhich
theLicensedSoftwareisrecordedis
defective,itwillbereplacedwithoutcharge,ifEnterasysingoodfaithdeterminesthatthemediaandproofofpayment
ofthelicensefeearereturnedtoEnterasysorthedealerfromwhomitwasobtainedwithinninety(90)daysofthedate
of
paymentofthelicensefee.
NEITHERENTERASYSNORITSAFFILIATESMAKEANYOTHERWARRANTYORREPRESENTATION,EXPRESS
ORIMPLIED,WITHRESPECTTOTHELICENSEDMATERIALS,WHICHARELICENSEDʺASISʺ.THELIMITED
WARRANTYANDREMEDYPROVIDEDABOVEAREEXCLUSIVEANDINLIEUOFALLOTHERWARRANTIES,
INCLUDINGIMPLIEDWARRANTIESOF
MERCHANTABILITYORFITNESSFORAPARTICULARPURPOSE,
WHICHAREEXPRESSLYDISCLAIMED,ANDSTATEMENTSORREPRESENTATIONSMADEBYANYOTHER
PERSONORFIRMAREVOID.ONLYTOTHEEXTENTSUCHEXCLUSIONOFANYIMPLIEDWARRAN TYIS

TOANYPARTYEVENIFENTERASYSORSUCHOTHERPARTYHASBEENADVISEDOFTHEPOSSIBILITYOF
SUCHDAMAGES.INNOEVENTSHALLENTERASYSORSUCHOTHERPARTYʹSLIABILITYFORANY

DAMAGESORLOSSTOYOUORANYOTHERPARTYEXCEEDTHELICENSEFEEYOUPAIDFORTHE

Somestatesdonotallowlimitationsonhowlonganimpliedwarrantylastsandsomestatesdonotallowtheexclusion
orlimitationofincidentalorconsequentialdamages,sotheabovelimitationandexclusionmaynotapplytoYou.This
limitedwarrantygivesYouspecificlegalrights,andYoumayalsohaveotherrightswhichvaryfromstatetostate.
