4. Using Gracenote CDDB
By using this product you agree to be bound by the following terms of use.
This product contains technology and data provided by Gracenote of Berkeley, CA. Gracenote
technology ("Gracenote Embedded Software") enables disc recognition as well as retrieval of
music information such as name, artist, track and title ("Gracenote Data"). This technology is
incorporated in "Gracenote Database".
● You will not use Gracenote Data, Gracenote Database and Gracenote Embedded Software
except for personal and non-commercial purposes.
● You will only access Gracenote Data using standard end-user functions and the functions of
this product.
● You will not assign, copy, or transfer Gracenote Embedded Software or Gracenote Data to
any third party.
● You will not use or apply Gracenote Data, Gracenote Database, or Gracenote Embedded
Software for any purpose not expressly permitted herein.
● In the event that you violate any of the these restrictions, your non exclusive license to use
Gracenote Data, Gracenote Database, and Gracenote Embedded Software will be
terminated. In the event that your license is terminated, you will cease all use of Gracenote
Data and Gracenote Database.
● Gracenote retains all rights pertaining to Gracenote Data, Gracenote Database, and
Gracenote Embedded Software, including but not limited to property rights.
● Gracenote can, in it's own name, on the basis of this agreement, fully exercise its rights
against any offending user.
You are hereby licensed to use Gracenote Embedded Software and Gracenote Data.
Gracenote hereby disclaims all warranties and statements, express or implied, with regard to
the truth of Gracenote Data accuracy. Gracenote can modify data categories or delete data in
the event that Gracenote has judged items to represent a clear problem or that an update is
required. Gracenote does not guarantee that Gracenote Embedded Software is free of errors
nor does it guarantee that Gracenote Embedded Software functions will be uninterrupted.
Gracenote bears no obligation to provide you with any new extensions of, or additions to,
available data types. Nor does Gracenote bear any obligation to provide you with any
categories offered in the future.
Gracenote makes no warranty whatsoever, whether express or implied, including but
not limited to implied warranties of merchantability, fitness for a particular purpose and
non infringement of rights. Gracenote makes no warranty regarding the results
obtained by using Gracenote Component or any Gracenote Server. Gracenote does not,
under any circumstances, accept responsibility for damage, be it consequential or
incidental in nature, nor does Gracenote accept responsibility for lost benefit or
income.
