B. It is your responsibility to impose any restrictions on viewing by you, other
members of your household, or guests, and we shall have no liability to anyone due to or
based on the content of any of the Services furnished to you.
8. WARNING AGAINST PIRACY
It is a violation of several U .S. federal and state laws to receive any Services, or any
portion of such Services, without paying for them. The penalties for violating such laws
can range from imprisonment to civil damage awards of up to $110,000 per violation.
9. MISCELLANEOUS
A. Physical Address/Change of Address. When setting up your DISH Network
account, you agree to p rovide us with the physical street address where the Equ ip ment
will be located. A post office box does not constitute a physical address and is not
sufficient to meet this requirement. You agree to give us prompt notice of your change of
nam e, mailing addre ss, ph ysic al ad dres s w here the E qu ipm ent is loca ted or tele phone
number. You m ay do thi s by notifying our Customer Service Center by telepho ne o r in
writing.
B. N otice
. If we send you notice, it will be considered given when deposited in
t he U.S . Mail, a ddresse d to you at your billing addr ess o r ha nd -delivered to you. O ur
notice to you will also be effective i f provided on your billing statem ent or by telephone.
If you give notice to us, it will be deemed given when received by us at the address listed
on the first page of this Agreement.
C. Applicable Law
. This Agreement, including all matters relating to its validity,
construction, performance and enforcement, shall be governed by applicable federal law,
the rules and regulations of the Federal Communications Commission, and the laws and
regulations of the state and local area where Service is provided. These terms and
con ditio ns are s ub ject to am e ndm e nt, mo dificatio n or terminatio n if req uire d by su ch
regul ati ons or law s. If a ny prov is i on in this Ag re em ent is decla red to be il leg al or in
conflict with any law or regulation, that provision may be deleted or modified, without
affecting the validity of the other provisions.
D. Other
. This document contains t he entire agreement between DISH Network
and you, t he custom e r, a nd no sa lesp erson , installer, cu stomer s ervice rep resen tative,
authorized retailer, or other similarly situated individual is authorized to change the terms
set forth herein. DISH Network may, how ever, change the terms and conditions of this
Agreement in the future and will notify you if that occurs. The terms of this Agreement,
which either are expressly stat ed to survive or by their nature would logically be expected
to survive termination, shall continue thereafter until fully performed.
Staying Legal
Title 47, Section 605(e )4, United States Code (U.S.C.) makes it a federal
crime to modify this receiver to enable it to receive encrypted (scrambled)
television programming without payment of required subscriptions.
Conviction can result in a fine of up to $500,000 and imprisonment for five
years, or both. Any owner of this receiver who procures or willfully causes
its modification is an accessory to that offense and may be punishable in the
same manner. Investigative authority for violations lie s with the Federal
Bureau of Invest igation (FBI).
This produc t may incorporate copyright protection technology that is
protected by U.S. pate nts and other intellectua l property rights. Use of such
copyright protec tion technology m ust be a uthoriz ed by Macrovision, and is
intended for home and other limited pay-per-view uses only unless
otherwise authorized by Macrovision. Reve rse engineering or dis assembly
is prohibited.
