These Limited Warranties shall be subject to the Consumer Guarantees Act 1993 ("the Act") unless
the Customer is a business or is being supplied by Dell for the purposes of a business, in which event
pursuant to section 43 of the Act, Dell and the Customer hereby agree that the Act shall not apply to
these Limited Warranties. Under the Act when implied conditions and warranties cannot be
excluded, Dell limits its liability in case of the Product, to the replacement of the Product or the
supply of the equivalent Product or the repair of the Product, or the paying of the costs for replacing
the Product or requiring equivalent Product, or the payment of the cost of having the Product
repaired; and in the case of services, to the supplying of the services again, or the payment of the cost
of having the services supplied again.
