In addition to any rights the Customer may have under statute, and to the extent permitted by
law, Dell undertakes at its option (a) in the case of defective products, the replacement of the
products or the supply of equivalent products; the repair of such products; the payment of the
cost of replacing the products or of acquiring equivalent products; or the payment of the cost of
having the products repaired OR (b) in the case of unsatisfactory services, the supplying of
those services again; or the payment of the cost of having the services supplied again.

These Limited Warranties shall be subject to the Consumer Guarantees Act 1993 ("the Act")
unless the Customer is a business or is being supplied by Dell for the purposes of a business, in
which event pursuant to section 43 of the Act, Dell and the Customer hereby agree that the Act
shall not apply to these Limited Warranties. Under the Act when implied conditions and
warranties cannot be excluded, Dell limits its liability in case of the Product, to the
replacement of the Product or the supply of the equivalent Product or the repair of the Product,
or the paying of the costs for replacing the Product or requiring equivalent Product, or the
payment of the cost of having the Product repaired; and in the case of services, to the supplying
of the services again, or the payment of the cost of having the services supplied again.
