CALIFORNIAEMISSIONCONTROLWARRANTYSTATEMENT
YOUR WARRANTY RIGHTS AND OBLIGATIONS
TheCaliforniaAir ResourcesBoardandMTDConsumerGroupInc are pleasedto explaintheevaporativeemissioncontrolsystemwarrantyon your2008lawn
mower.InCalifornia,new lawnmowersmust bedesigned,built and equippedto meetthe State'sstringentanti-smogstandards.MTDConsumerGroupIncmust
warrantthe EECSon yourlawn mowerfor the periodof timelisted belowprovidedthere hasbeennoabuse,neglector impropermaintenanceof yourlawn mower.
YourEECSmayincludepartssuch asthe carburetor,fuel-injectionsystem,the ignitionsystem,catalyticconverter,fuel tanks,fuel lines,fuel caps,valves,
canisters,filters,vaporhoses,clamps,connectors,andother associatedemission-relatedcomponents.
Where a warrantable condition exists, MTDConsumer Group Inc will repair your lawn mower at no cost to you includingdiagnosis, parts and labor.
MAN UFACTURER'S WARRANTY COVERAGE:
Thisevaporativeemissioncontrolsystemiswarrantedfor two years.Ifany evaporativeemission-relatedpart onyour equipmentisdefective,the partwill be
repairedor replacedby MTDConsumerGroupInc.
OWNER'S WARRANTY RESPONSIBILITIES:
Asthe lawn mowerowner,youare responsiblefor performanceof the requiredmaintenancelisted in yourowner'smanual.MTDConsumerGroupIncrecommends
thatyou retainall receiptscoveringmaintenanceon yourlawn mower,butMTDConsumerGroupInccannotdenywarrantysolelyfor the lackof receipts.
Asthe lawn mowerowner,youshouldhoweverbeawarethat MTDConsumerGroupInc maydeny youwarrantycoverageif yourlawn moweror a part hasfailed
dueto abuse,neglect,orimpropermaintenanceor unapprovedmodifications.
Youare responsiblefor presentingyourlawn mowerto MTDConsumerGroupInc'sdistributioncenteror servicecenteras soonas the problemexists.The
warrantyrepairsshouldbecompletedin a reasonableamountoftime, notto exceed30 days.If youhavea questionregardingyourwarrantycoverage,youshould
contactthe MTDConsumerGroupIncServiceDepartmentat 1-800-800-7310.
GENERAL EMISSIONS WARRANTY COVERAGE:
MTDConsumerGroupIncwarrantsto the ultimatepurchaserand eachsubsequentpurchaserthat the lawnmoweris: Designed,builtandequippedso as to
conformwithall applicableregulations;andfree fromdefectsin materialsandworkmanshipthatcausethe failureof a warrantedpart to be identicalinall material
respectstothat partas describedin MTDConsumerGroupInc'sapplicationfor certification.
Thewarrantyperiodbeginsonthedate the lawnmoweris deliveredto an ultimatepurchaseror firstplacedintoservice.The warrantyperiodis two years.
Subjecttocertainconditionsand exclusionsasstatedbelow,the warrantyonemission-relatedparts is asfollows:
1. Any warrantedpart that isnotscheduledfor replacementas requiredmaintenancein thewritten instructionssupplied,is warrantedforthe warrantyperiod
statedabove.Ifthe partfails duringthe periodof warrantycoverage,thepartwill berepairedor replacedbyMTDConsumerGroupInc accordingto subsection
(4)below.Anysuch part repairedor replacedunderwarrantywillbewarrantedfor the remainderof the period.
2. Any warrantedpart that isscheduledonly for regularinspectionin the writteninstructionssupplied is warrantedforthe warrantyperiodstatedabove.Any such
partrepairedor replacedunderwarrantywill bewarrantedforthe remainingwarrantyperiod.
3. Any warrantedpart that isscheduledfor replacementas requiredmaintenancein thewritten instructionssuppliedis warrantedfor the periodof timebeforethe
firstscheduledreplacementdatefor that part.If the partfails beforethefirst scheduledreplacement,the partwill berepairedorreplacedby MTDConsumer
GroupIncaccordingto subsection(4)below.Anysuch part repairedor replacedunderwarrantywill bewarrantedfor the remainderof the periodpriorto the
firstscheduledreplacementpointforthe part.
4. Repairor replacementof any warrantedpart underthe warrantyprovisionshereinmustbeperformedat a warrantystationatno chargeto the owner.
5. Notwithstandingthe provisionsherein,warrantyservicesor repairswill be providedat allof our distributioncentersthatare franchisedto servicethe subject
enginesor equipment.
6. The lawnmowerowner willnot bechargedfor diagnosticlaborthat is directly associatedwith diagnosisof a defective,emission-relatedwarrantedpart,
providedthat suchdiagnosticworkis performedat a warrantystation.
7. MTDConsumerGroupInc is liablefor damagesto otherengineor equipmentcomponentsproximatelycausedby a failureunderwarrantyof any warranted
part.
8. Throughoutthe lawnmowerwarrantyperiodstatedabove,MTDConsumerGroupIncwill maintaina supplyof warrantedpartssufficientto meetthe expected
demandfor suchparts.
9. Any replacementpart maybe usedinthe performanceof any warrantymaintenanceor repairsand mustbe providedwithoutchargeto the owner.Suchusewill
notreducethe warrantyobligationsof MTDConsumerGroupInc.
10.Add-onor modifiedpartsthat are notexemptedbythe AirResourcesBoardmaynot beused.Theuse of any non-exemptedadd-onor modifiedpartsby the
ultimatepurchaserwill begroundsfor disallowinga warrantyclaims.MTDConsumerGroup Incwill notbe liable to warrantfailuresof warrantedpartscaused
bythe useof a non-exemptedadd-onor modifiedpart.
