10 Limited Product Warranty
Information
This product is subject to the Biocomfort One-
Year Limited Warranty separately included in
this box and also available from Biocomfort or
any authorized Biocomfort dealer or from
Biocomfort’s website at
http://www.biocomfort.com/support.
If you do not agree with, and do not want to be
bound by, the terms of the Biocomfort one-year
limited warranty, return the box and its contents,
including the hardware and accessories unused,
to Biocomfort, or to the authorized Biocomfort
dealer where you purchased the product, within
fourteen (14) days of purchase, together with
proof of purchase, and your full purchase price
will be refunded. By using this product or letting
the 14-day period lapse, you agree to the terms
of the Biocomfort one-year limited warranty.
11 Limitation of Liability and
Exclusion of Statutory Remedies
To the maximum extent permissible by
applicable law, in no event shall Biocomfort or
its direct, indirect and ultimate parent
companies, its other affiliates, or their respec-
tive licensors, be liable for any consequential,
indirect, special, incidental, punitive or other
damages whatsoever, including without
limitation damages for loss of future or
anticipated business profits, loss of goodwill,
loss of revenue, loss of business opportunity,
business interruption, loss of business
information, or any other pecuniary loss, and
including under any claim of negligence, strict
liability, design defect, or other theory, arising
from (1) any defect in the software or the use of
or inability to use the software or firmware
installed on any hardware sold to you, or
furnished with or referenced, in this user
manual or from the licensing of the software or
firmware by Biocomfort or the provisionany
services by Biocomfort or Biocomfort USA, (2)
any defect or error in this user manual or any
other documentation, even if Biocomfort
and/or Biocomfort USA have been
advised by you of the possibility of such
damages.
To the maximum extent permitted by
applicable law, Biocomfort and its direct,
indirect and ultimate parent companies,
its other affiliates, its suppliers and its
contract manufacturers shall have no
liability for punitive, special, incidental,
consequential or indirect damages
resulting from the purchase or use or non-
use of any Biocomfort product or any part
thereof, from any product defect, from
any damage to real or personal property,
from any use in disregard of any
instructions or any warnings attached to
or furnished with the product, or from
breach of warranty, breach of contract,
negligence, tort liability, strict liability, or
any other legal or equitable theory, and
you hereby irrevocably waive all claims
to that effect. Excluded damages shall
include, but not be limited to, product
(re-)installation expenses, loss of
anticipated benefits, profits, savings or
revenue, loss of goodwill, business
interruption damages, loss of time or use
of the product, any third party claim, and
injury to property, even if Biocomfort
knew of the likelihood of such damage.
The maximum liability of Biocomfort, its
parent company, affiliates, and suppliers
with respect to all applicable express and
implied warranties shall not exceed the
purchase price amount paid for the
Biocomfort product. Some states do not
allow the exclusion or limitation of
special, incidental, consequential or
indirect damages, so the above limitation
and exclusion may not apply to you.
