WARRANTY AND SERVICE
Limited Warranty
Avayaguaranteestotheenduser(the“Customer”)thatthisproductwillbefreefromdefectsin
workmanshipandmaterials,undernormaluseandservice,foraperiodoftwo(2)yearsfromthe
dateoforiginalpurchasefromitsauthorizeddistributor.Avaya’ssoleobligationunderthisexpress
warrantyshallbe,atAvaya’soptionandexpense,torepairthedefectiveproductorpart,ordeliverto
theCustomeranequivalentproductorparttoreplacethedefectiveitem.
AllproductsthatarereplacedwillbecomethepropertyofAvaya.Replacementproductsorpartsmay
beneworreconditioned.Anyreplacedorrepairedproductorpartcarriesaninety(90)dayslimited
warrantyortheremainderoftheinitialwarrantyperiod,whicheverislonger.Productsreturnedto
Avayamustbesentprepaidandpackagedappropriatelyforsafeshipment.Itisrecommendedthat
the package is insured or sent by a method that enables tracking of the package.
ResponsibilityforlossordamagedoesnottransfertoAvayauntilthereturneditemhasbeenreceived
byAvaya.TherepairedorreplaceditemwillbeshippedtotheCustomer,atAvaya’sexpense,notlater
thantwelvedays(12)daysafterAvayahasreceivedthedefectiveproduct,andAvayawillretainrisk
of loss or damage until the item has been delivered to the Customer.
Exclusions
Avayashallnotbeliableunderthislimitedwarrantyifexaminationandtestsofthereturnedproduct
revealthattheallegeddefectormalfunctionintheproductdoesnotexistorresultsfrom:
• FailuretofollowAvaya’sinstallation,operationormaintenanceinstructions.
• Unauthorizedproductmodicationoralteration.
• Unauthorizeduseofcommoncarriercommunicationservicesaccessedthroughtheproduct.
• Abuse,misuse,negligentactsoromissionsonthepartoftheCustomerandpersonsunderthe
Customer’s control; or
• Actsofthirdparties,forcemajeure,accident,re,lightning,powersurges,outagesorother
hazards.
WARRANTYEXCLUSIVE:IFANAVAYAPRODUCTDOESNOTOPERATEASWARRANTEDABOVE,
CUSTOMER’SSOLEREMEDYFORBREACHOFTHATWARRANTYSHALLBEREPAIROR
REPLACEMENTOFTHEPRODUCTINQUESTIONATAVAYA’SOPTION.TOTHEFULLEXTENT
ALLOWEDBYLAW,THEFOREGOINGWARRANTIESANDREMEDIESAREEXCLUSIVEANDARE
INLIEUOFALLOTHERWARRANTIES,TERMS,ORCONDITIONS,EXPRESSORIMPLIED,EITHER
INFACTORBYOPERATIONOFLAW,STATUTORYOROTHERWISE,INCLUDINGWARRANTIES,
TERMS,ORCONDITIONSOFMERCHANTABILITY,FITNESSFORAPARTICULARPURPOSE,
SATISFACTORYQUALITY,CORRESPONDENCEWITHDESCRIPTION,ANDNON-INFRINGEMENT,
ALLOFWHICHAREEXPRESSLYDISCLAIMED.AVAYANEITHERASSUMESNORAUTHORIZESANY
OTHERPERSONTOASSUMEFORITANYOTHERLIABILITY.
