a. For Software that implements the MPEG-4 Visual Standard: PORTIONS OF THIS PRODUCT
ARE LICENSED UNDER THE MPEG-4 VISUAL PATENT PORTFOLIO LICENSE FOR THE
PERSONAL AND NON-COMMERCIAL USE OF A CONSUMER FOR (I) ENCODING VIDEO IN
COMPLIANCE WITH THE MPEG-4 VISUAL STANDARD (“MPEG-4 VIDEO”) AND/OR (II)
DECODING MPEG-4 VIDEO THAT WAS ENCODED BY A CONSUMER ENGAGED IN A
PERSONAL AND NON-COMMERCIAL ACTIVITY AND/OR WAS OBTAINED FROM A VIDEO
PROVIDER LICENSED BY MPEG LA TO PROVIDE MPEG-4 VIDEO. NO LICENSE IS
GRANTED OR SHALL BE IMPLIED FOR ANY OTHER USE. ADDITIONAL INFORMATION
INCLUDING THAT RELATING TO PROMOTIONAL, INTERNAL AND COMMERCIAL USES
AND LICENSING MAY BE OBTAINED FROM MPEG LA, LLA. SEE

b. For Software that implements the AVC Standard: PORTIONS OF THIS PRODUCT ARE
LICENSED UNDER THE AVC PATENT PORTFOLIO LICENSE FOR THE PERSONAL USE OF
A CONSUMER OR OTHER USES IN WHICH IT DOES NOT RECEIVE REMUNERATION TO (i)
ENCODE VIDEO IN COMPLIANCE WITH THE AVC STANDARD (“AVC VIDEO”) AND/OR (ii)
DECODE AVC VIDEO THAT WAS ENCODED BY A CONSUMER ENGAGED IN A PERSONAL
ACTIVITY AND/OR WAS OBTAINED FROM A VIDEO PROVIDER LICENSED TO PROVIDE
AVC VIDEO. NO LICENSE IS GRANTED OR SHALL BE IMPLIED FOR ANY OTHER USE.

d. Use, Regulatory, and Compliance with Law.
1. The telethermographic system on which the Software is loaded (the “Device”) may be subject to
clearance or approval in different jurisdictions and is not cleared or approved for use in all countries.
In the United States, the Device is not cleared or approved by the U.S. Food and Drug Administration
(the “FDA”) and is being marketed and sold under FDA guidance issued on April 16, 2020
(https://www.fda.gov/media/137079/download) (the “Guidance”), which is intended to remain in
effect only for the duration of the public health emergency related to COVID-19 declared by the U.S.
Department of Health and Human Services.
2. Johnson Controls does not and cannot guarantee that the Device will be granted FDA clearance in
the United States or clearance for use in any other country.
3. The Software and the Device are intended to be used only:
i. for triage purposes to perform initial skin temperature measurement;
ii. where an elevated skin temperature measurement is confirmed in the context of use with
secondary evaluation methods (e.g., non-contact infrared thermometer (NCIT) or clinical grade
contact thermometer); and
iii. where such devices do not create an undue risk in light of the public health emergency.
4. Additional Guidance:
i. the Software and the Device should not be solely or primarily relied upon to diagnose or exclude a
diagnosis of COVID-19, or any other disease;
ii. public health officials, through their experience with the Device in the particular environment of
use, should determine the significance of any fever or elevated temperature based on the skin
telethermographic temperature measurement;
iii. the system and technology should be used to measure only one subject’s temperature at a time;
and
